About Chapter 7 Bankruptcy Filing Fees
Tuesday, 10 November 2009 21:54Although a Chapter 7 bankruptcy is one of the most effective ways to protect yourself from massive debt, the process is not free. There are certain filing costs and fees that you should be aware of before you file. If you choose to be represented by an attorney, (a good choice given the complexity and nature of bankruptcy), there will be attorney fees and costs. But, even if you choose not to use an attorney you would likely still have to pay a court filing fee to file a case.
There is a $245 filing fee for a chapter 7 bankruptcy, a $15 trustee surcharge and a $39 administrative fee. This brings the total for filing a chapter 7 to $299.
Under normal circumstances these fees must be paid upfront to the clerk of the court. Sometimes though, special circumstances will permit you to pay this amount in smaller installments. This exception is limited to 4 installments and the final installment must be paid in less than 120 days. In the case of a joint filing, only one filing fee and one administrative fee need to be paid.
If your finances are out of control, filing a chapter 7 bankruptcy may be your best option for recovery. You can speak with a skilled and experienced bankruptcy attorney right now for a free evaluation of your case. Call 800-260-1402 to start getting your life back on track.
